The HOA covenants, conditions and restrictions (CC&Rs) and Ohio law give the board the legal right to take escalating actions in an effort to collect outstanding HOA dues.
Late fees
Per Article V, Section 4 of the CC&Rs, the board is authorized to levy compounding interest at 10% per year for any unpaid balance until paid.
Liens
Per Article V, Section 5 of the CC&Rs, the board is authorized to place a lien on the property for any unpaid balance. Liens will prohibit the sale or refinance of your home until paid. Additionally, all lien costs (as identified by Wood County), and any attorney costs to apply them become added to the lien.
Foreclosure
Per Article V, Section 5 of the CC&Rs as well as Ohio Rev. Code § 5312.12(B)(4), the board is authorized to foreclose on any liens filed by the homeowners association. All costs associated with this action would also be the responsibility of the homeowner and would be added to any judgment. Local attorneys estimate this action would add at least $600 to the debt of the property.
